EVERYBODY!!!!!

Don't know what I'd do without my Saturday "Felix Fix".  (Felix Hernandez's "Rhythm Revue" on WBGO.org.)  I know WBGO does fund raising several times a year, so I don't know if they would have gone off the air immediately.  It would have caused plenty of headaches, one way or the other.

Hi Dream!

I saw this nightmare facing Internet Radio coming down the pike back at the end of February, and that's why I started blogging hard in March/April... never thinking that it would ever get to this level of unfairness and corruption leveled by the Vampire SoundExtort ... err Soundexchange.
...but it did.

Internet Radio is now hanging on by a thread in this temporary stay of execution,,, and we must push even harder now to get HR 2060 passed in Congress... as Americans fighting together for fairness and a level playing field of equal opportunity for all of us in MUSIC, all of us who love Music and "our right to be able to hear our music"!

This MUST be done before Internet Radio as we know it... becomes history and what's left is owned by a few Greedy RIAA Major Labels feeding us "more crap", and crushing/ muting/ deleting every Indie Artist, Indie Label, Indie DJ, Indie Station and every Genuine, Creative Expression & Thought in sight.

EVERYBODY --- KEEP CALLING CONGRESS!!!!!!

Hi Geno!!!

I know my senators & congressmen personally.  I'm also friendly with some of their field reps.  I will call the four offices Monday morning.

You've put together an excellent & informative thread here.  I hope everyone at Soulful Planet will read it and take action.  Members of Congress DO listen to their constituents.

Good Job!!!

Thank You Dream!!!

I must say the offices in Washington, and the offices of my representatives here in Pennsylvania have been very pleasant to talk to. You are right... they do listen, and are happy to hear that someone is passionate about what they believe is simply the right thing to do.

THIS communication alone gave me some hope for our system of government... diffusing some of my original outrage at the things that I'd discovered.

My first letter to Congress about the CRB Tribunal decision rendered in favor of SoundExchange's big money lobbying efforts and the dismissing of Save Internet Radio's plea for fairness and equality ... was quite angry:

"This decision reeks of payola, and under the table kickbacks and unfair competition. CNN, ABC, CBS, NBC, MS-NBC, Fox News PLEASE let the Corruption Investigations into ALL of this begin now! Our government obviously no longer cares about the tax paying small business owners and INDIES in the "MUSIC" industry fighting to simply survive in an already unlevel playing field. What's FAIR is FAIR. This decision is obviously UNFAIR to even the casual observer. ...Do we still live in America?"

I've calmed down now since that writing, but no doubt, H.R. 2060 needs to get passed for the good of MUSIC for ALL of US.

Dream, what You are saying is obviously "very good music to the ears"!!!
This is a huge help, and every bit helps.

Geno

Thank you Mixey & Geno.

Geno - I hope you received written answers to your letters.  It was a good one.  You're entitled.  Don't worry that you were angry - many letters they recieve are.  You weren't threatening anyone - you were expressing your opinion on an issue they will vote on.  Remember the squeaky wheel gets the grease.

The Congressman I worked for here in Maine even responded to every phone call with a letter.  Current Senators Olympia Snowe (she's married to my former boss who was Congressman & Governor) and Susan Collins do send letters to constituents in response to their opinions and requests.  I have lobbied my current Congressman Tom Allen in the past, but never received a response of any kind.  That's bad form IMO, so if you don't hear back from them, keep at it.  You're paying their salary and that of their staff.  Too often we forget they work for us, not the other way around.  lol  When I worked in a Congressional & gubernatorial office, we were reminded of that fact frequently by our boss.

I hope anyone who loves music and freedom of choice (there's an element of that here) will take a few minutes to contact their elected representatives.  That's what they are there for!

Thanks Dream!!!

Yes, I have rec'd back encouraging email responses.
They obviously have read my words. Very encouraging!

Ok todays UPDATE: July 16th, 2007
Stellar article from:

News From Audio Graphics —
"SoundExchange, Internet Radio, and the Noisy Silence
It's been a roller coaster..." (read here!)

—"...I loved the scenario posed by SoundExchange, where it brought up how no musicians benefitted from the sale of Last.FM to CBS, and I'm wondering why it did not mention that no musicians benefited from the record industry's consolidation..."

I am so tired of the smoke and mirrors game from SoundExchange. Bottom line, very few of us... Artists, Producers, Musicians, Engineers, Writers, Publishers, Indie Labels, Internet Broadcasters, DJ's, OnAir Talent, Listeners & Fans will benefit in any way from any of this Mandate from SoundExchange ...
until Fairness & Equality become THE KEY ELEMENTS employed in the negotiations and agreements.

I think we have a right to have a say in what happens to the music that WE create! Agreed?
So far, SoundExtort has never even simply "asked" one of us! Is THIS asking too much... and if so, then what is "the plan b option" alternative choice to SoundExchange representing ALL MUSIC ROYALTY 'TAX COLLECTION' ON THE INTERNET? ............ ohhhhhhh SoundExtort is a monoply, and we have no say!
(...didn't we fight a war about something like that?) *blink,blink*

~Peace,~
Geno

p.s Ok... How long until we are ALL screaming "ABOLISH SOUNDEXCHANGE?"
I've been saying it for a while now... just let ASCAP & BMI handle this... they seem to do things fairly for ALL involved, at far less "cost" and "blood loss"!

"Web radio firms cry foul over DRM proposal
Cap offer comes with anti-piracy strings"
By OUT-LAW.COM — "The Register"
Published Monday 23rd July 2007 09:14 GMT

(read The Register Article here)
"...The uncapped $500-per-channel minimum fee generates more than $1bn annually for what the CRB determined are supposed to cover SoundExchange's administrative costs," said Potter. "This is far more money than needed to administer a mere $20m in internet radio royalties."

Wait! COME AGAIN!
SoundExchange's administrative costs will be $1 Billion needed to administer a mere $20 Million in internet radio royalties"???

Huh? Sure smells like some Florida Voting Math going on here.

Looks like SoundExchange has some "administrative costs" explaining to do... and once again, please explain how any of this money in any way gets anywhere near... oh let's say...
An Artist, A Writer, A Publisher, A Musician, A Vocalist, An Engineer, An Indie Label, or... Any Creative People Directly Involved???

SoundExchange... Speak up, please... for some reason we're not hearing YOUR ANSWER!

Jeff!!!

Thank You! I could not agree more... yesterday, I had more I wanted to write, but I could not. I had to walk away. I was getting so frustrated with all of this... and this is only a micro-cosm of what is going on in this country. It can become so unbelievable, so frustrating, and make everything that is basic, everything that is good, everything that is clearly "the right thing to do" for ALL of us... so impossibly unreachable.   Yet I know that this frustration is exactly the "do nothing" problem that ends up being the end result... and the status quo inequality continues, unchecked, unquestioned, as big money lobbyists and the good old boys pat each other on the back... as more tiny parts of our freedom... one by one, like tiny grains of beach sand, erode away.

ughhhhhhhhhhhh!

Well, it looks like the rumblings have begun for the upcoming Christmas Holiday Season... the vibe seems to be heading this way:

Give The Gift Of Music... Support Indie Labels, Indie Artists, Indie Radio... Boycott the RIAA Label Releases!

Online radio and musicians unite for survival
Written by Peter Katona - Tuesday, 24 July 2007
-
"...many musicians and online radio stations refuse to give up the fight. One such station, iwebradio.com, is organizing the “Don’t Buy Into It” campaign, asking its nearly 44,000 listeners to boycott major record labels for six months starting in October, the start of the holiday shopping season."

Would this work?

RIAA Radar Search
"You can search for particular artists, albums, record labels, and a whole bunch of other crap using the search box on the left. Use the pulldown to select a more specific thing to look for, otherwise it will just run a generic keyword search (which is fine, if you're into that kind of thing.)"

Here is a website that allows you to search for "RIAA SAFE" Label Artist Releases:

RIAA Radar Search:

Keep in mind, the RIAA was once upon a time "Artist Friendly", so many older albums and CD's will show up with a current "RIAA WARNING", even from Artists that are now on Indie Lables.
Their NEW "Indie Label Releases" (i.e. Non-RIAA releases) will show up as "SAFE"... make sense?

~~~ p.s. ~~~~
From The Department of "Major Label Age Discrimination"...
five years later...
Santana Releases Duet With Tina Turner
By NEKESA MUMBI MOODY
The Associated Press
Monday, July 23, 2007; 7:41 PM
Santana Releases Duet With Tina Turner — "Santana says that executives at his record label at the time apparently weren't interested in having Turner on the track."
(((Jeez! That only took the Label Exec's 5 years... hopeless!)))
"No truce in store; RIAA fails in attempt to attack Internet radio"
ALEC WOODEN — RedandBlack.com
Issue date: 7/19/07 Section: Variety
(read here) —
"The (Music) industry isn't owned by a few big players anymore. It's owned by MySpace, Indie labels and it's soon to be owned by groups like Pandora."
He makes some good points here, but I'm not sure about the "RIAA fails" part. We all know, it's far from over. It's kinda like saying sharks no longer bite people swimming in water.
Hi Alec,
You wrote: "The (Music) industry isn't owned by a few big players anymore. It's owned by MySpace, Indie labels and it's soon to be owned by groups like Pandora."
Thank You. You make some good points here, but I'm not sure about the "RIAA fails" part. We all know, it's far from over. It's kinda like saying sharks no longer bite people swimming in water.
The once friendly RIAA is now tenacious and relentless. When they wake up, get rid of their current administration and get back to doing honestly great things for the Creation of Great Music and Talent, (instead of feeding lawyers at the Artist's & Music Lovers' expense), there might be hope for saving them from extinction... as I have said for years in this industry... a level playing field for ALL in MUSIC is simply the right thing to do.
July 29, 2007 - Radio Ink - Publishers Notes —
RE: "6/18/07 The Clear Channel Factor"
July 29, 2007 - (read here)
"...the Clear Channel effect has permeated a generation of listeners who think radio is not cool"... the article continues, and then asks...
"Is it worth an investment in a massive, multi-million dollar PR and marketing campaign to turn this negative tide? "
~~~

I responded in a comment to this article, and sent the following:

Clear Channel -
Gentlemen & Ladies,

With all due respect... a PR Campaign? Are you serious?

Simple solution:
(1) Put radio back and radio programming back in the hands of genuinely talented, gifted on-air talent./DJ's and cooperative, supportive "LOCAL" station programming directors.
(2) Let these talented people do what they do best, playing "live" from full bandwidth CD's and Vinyl (face it, pre-programmed MP3's sound like "crap" over FM- go for the quality edge).
(3) Open up "our airwaves" back to a level playing opportunity for genuine musical talent and performance, regardless of "Major Label" connection! (i.e. be honest and supportive and nurturing to Indie Labels, Indie Talent, Seasoned Talent AND New Artists and Genuinely Talented Musicians and Artists that this country actually wants to hear).
(4)   Stop force feeding America... Major Label "crap".
(5)   De-emphasize Genre, de-emphasize Demographics... create "GOOD BROADCASTING" in every sense of the term, (not-narrowcasting)... and watch terrestrial ratings swell to levels that will exceed the broadcasting glory days of old. America is hungry for quality and honesty in a broad, genuine scope.
(6) You all know the answer to this...
"What's the right and honest thing to do here for America?" really think about that one... hard, and then simply do the right thing. It's not too late... yet.
Do the right thing and then watch your ratings go thru the roof.

Wired.com is reporting that the Internet Radio Equality Act is bogging down in Congress and is most likely not to be acted upon.
Congress is apparently hoping for Sound Exchange and Webcasters to work out some kind of compromise agreement.

Two Senators, one being Sen. Brownback has said that he would push for some kind of passage of the Senate version of the same bill, however, without support of Congress this will also come to naught.

This is the situation as of tonight, August 6 and thought you should all know the situation report.

Great ideas, but they probably won't happen. Doing them would cost more money, cutting into Clear Channel's bottom line, which their shareholders will never go for. If it's bad for big business and good for small business and/or consumers, most likely it ain't gonna happen in the U.S.A, unless there is significant public pressure, at which time our elected officials *suddenly* remember that they are supposed to be working on behalf of citizens and not lobbyists.
