So Are Those TV commercials Too Loud For Ya during Those Reality Tv Shows and Late Night Informercials?

This is for real.

H.R. 6209: Commercial Advertisement Loudness Mitigation Act

— H.R. 6209: Commercial Advertisement Loudness Mitigation Act —
To require the Federal Communications Commission to prescribe a standard to preclude commercials from being broadcast at louder volumes than the program material they accompany.


The Senate and House of Representatives in Congress are considering the Commercial Advertisement Loudness Mitigation Act. This would require the FCC to come up with a standard to reference level so that commercials can not be broadcast Louder than the program material that they precede or follow.

H.R. 6209 and S. 3154) states:
"Within one year after the date of enactment of this Act, the Federal Communications Commission shall prescribe pursuant to the Communications Act of 1934 (47 U.S.C. 151 et seq.) a regulation that provides, in connection with any video programming that is broadcast or that is distributed by any multichannel video programming distributor, that—

(1) advertisements accompanying such video programming shall not be excessively noisy or strident;

(2) such advertisements shall not be presented at modulation levels substantially higher than the program material that such advertisements accompany; and

(3) the average maximum loudness of such advertisements shall not be substantially higher than the average maximum loudness of the program material that such advertisements accompany."

What, are they going to do... send out violation fines to the cable providers for audio peaks that spike by the quarter db above a benchmark maximum level at given frequency range for a certain duration of time? How would this be easily enforced?

AND... if that were the case, then I have a funny feeling that to still play the volume wars, the cable TV providers would squash the hell out of ALL of the audio, and max everything out at the 1000Hz to 5000hHz range, because at the same volume level, this area is what the human ear hears the loudest (think alarm clocks. fire sirens, or construction equipment backup warning beeps, a baby crying). *

Oh, now this would be an improvement, wouldn't it!

I can just see the audio production sound design scripts now...

It's so ridiculous it's comical, but also pathetic.  What some rookie reps won't do to get their name on a piece of legislation!!  I hope her opponent in the next election jumps all over this folly.  If they're smart, they will!!!
